This points out that there are real risks to driving nude, so discretion is needed. In this case he seems to have been drunk, so discretion was lacking.

The drunk driving arrest was on a separate occasion from the complaint about going through a Wendy's drive-through naked. There is nothing in the press account indicating he was drunk while nude, not that I'd be surprised.

Would it have been OK if he had placed a towel in his lap? I suspect he would still have been charged.

In most people's minds it is less the actual sight of nudity that causes them harm (meaning no harm at all), rather it is their imagination of what the person is up to that upsets them.
