    Arkansas anti-nudism law: sensible or silly?

    Nudism is accepted or at least tolerated everywhere across North America. Everywhere, that is, except the state of Arkansas. Arkansas has a law the strictly prohibits the practice of going socially nude in mixed settings, or even advocating the practice

    This tells me its legal for the same gender to be together nude in social practice. So the guys and gals can socialize nude separately in groups doesn't it?

    I have also heard its illegal to plan, arrange, discuss nudist club or activities [Even in Private homes] or rent a facility for the same.


    I think with good legal representation, this poorly written law could be challenged sucessfully.

    To take it to court you would actually have to be charged under it - and as far as I can tell, no one has ever been charged under this law - and it's easy to see why, no competent prosecutor would bother wasting public resources prosecuting under such a clearly unconstitutional law.

    But despite it's non-enforcement it has a chilling effect on nudism in Arkansas. You may be able to discuss nudism, despite the legal prohibition, but you could never get a bank loan or the insurance necessary to open a nudist resort or club. Therefore there are no nudist clubs in Arkansas to challenge the law.

    For those of you praising "nudist pioneers" -- be one yourself!

    Either move to Arkansas, or find someone there.

    Organize a provisional non-landed nudist club. Take out an ad in the Bulletin. Also 'N'. Get a group together.

    Do you walk down Main Street naked? NO.

    Plan a party. Invite the world. Announce it in your local paper.

    Then - see if the authorities come and arrest you. If they do, you've got your legal case for appeal! YOU CAN BE - A PIONEER!

    Oh, a few things I didn't tell you. Just minor details.

    1) You'd better have a good amount of moolah to pay your legal fees.
    2) You might lose your job. If you are in an "at will" state, and have a good job, once you hit the papers, kiss it goodbye.
    3) If you are convicted on the first go-round, you're convicted until the day comes some years down the road (if it does at all) when your conviction is overturned.

    But - if you're a pioneer - GO FOR IT!

    I have been to Arkansas. In fact, I have been have to city of Hope where Pres Bill Clinton was born-they a museum there. Arkansas is a very pretty state. Frankly I liked it there.

    likely the law is unconstitutional-however as UsuallyLurk correctly states, changing the law is quite another matter. You try to change that law-and you could suffer serious consequences.

    Further, I doubt an attorney there would be all that willing to take the case for fear of reprecussions.

    From someone who moved to there, it has a lot of rattlesnakes and black widow spiders. Maybe the nudity ban is to afford a little protection from them.

    Arkansas papers won't touch a ad for nudism, because nudism is against the law. That's one thing that happened to Shaybares' River Valley Naturist Club just across the line in Oklahoma couldn't advertise it.
