Greetings.
Very good news! This is an Update from the Naturist Action Committee (NAC). In coordination with local Oregon naturists and groups, NAC asked you last month to send comments to the Oregon Department of Forestry (ODF), concerning proposed changes to rules that would have adversely affected naturists in State Forests.
You responded by contacting ODF (and copying NAC). NAC THANKS YOU! Your thoughtful comments have played a significant role in persuading ODF to reconsider its restrictive and punitive proposals addressing nudity.
ANTI-NUDITY RULES REMOVED!
The proposed prohibitions against simple nudity have been removed from the ODF rules, and the revised rules (with no mention of nudity) have been adopted.
QUICK BACKGROUND
The Oregon Department of Forestry proposed changes to ODF's rules regarding conduct and activities within "Designated Recreation Areas" on state forest lands.
A legislative bill addressing ODF's management of State Forests had been passed in 2015 by the Oregon legislature and signed into law by the Governor. Although that legislation (House Bill 2453) authorized ODF to require organizers to obtain permits prior to conducting large commercial events on state forest lands, lawmakers never mentioned the prohibition of nudity. ODF bureaucrats added that rule on their own.
WHAT IS NAC ASKING YOU TO DO?
This is an Update. NAC is not asking you to take further action on this matter at this time.
WHAT DID NAC DO?
NAC board member Don Zirbel reports:
The Oregon Department of Forestry Board met this past week, and at the recommendation of their Policy Analyst, removed the proposed anti-nudity language, and all other references to nudity, from their Division 25 Rules pertaining to Designated Recreation Areas. The rules would have made acts of simple nudity a Class A Misdemeanor, which in Oregon carries up to a $2500 fine. I also got them to delete a poorly worded provision that would have (presumably inadvertently) created the potential for elevating simple nudity on any state forest land into a Class C Misdemeanor, which carries a possible 30-day jail term in addition to a fine.
ODF noted that they received 175 comments from the public in opposition to the nudity rule, and none in favor. It is my belief, based on ODF's response to my testimony at the public meeting I attended in January, that the 2015 NEF U.S. Poll played a large part in educating them regarding public opinion toward nude recreation on public lands. It's also evident that the NAC Action Alert directly prompted a sizable portion of the public responses, based on the number of comments that were cc'd to NAC, as requested by the NAC Action Alert. NAC acknowledges and thanks the American Association for Nude Recreation and the Northwest Region of AANR for their commitment to this issue and the participation of their volunteers in opposing the proposed anti-nudity rules.
