  • Nudists should support the Equal Rights Amendment

If the Equal Rights Amendment were ratified, a woman would have the right to go topless any place a man can go topless.

I view the right of women to go topless as a stepping stone to getting legally designated nude beaches across the nation. The sight of topless women would become more common in the media, which would lead to greater acceptance among the public.

The present status of the amendment is that the required thirty-eight states have ratified it following ratification by Virginia in 2020; however, several states revoked their ratification, and the original legislation that started the ratification process had a 1979 deadline. It has been proposed that Congress pass new legislation eliminating the expiration date. It would then become a matter for the courts to decide whether states can revoke their ratification.

The text of the amendment appears below.

    ARTICLE —
Section 1. Equality of rights under the law shall not be denied or abridged by the United States or by any State on account of sex.
Sec. 2. The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.
Sec. 3. This amendment shall take effect two years after the date of ratification.
