You buy a house next to an empty lot with a tall Fence and put a swimming pool in the back yard often your family and friends go skinny dipping... One day you see the construction of a new two-story house being built which will be able to see into your yard. How would you react?

While this a bit off topic I can understand the frustration. The lay of the land where I live features my house and my neighbors home facing the road, past the neighbors house was the wooded backyards of the homes facing the street behind our homes.. One of te owners of these other homes decided to sub-divide their property and sold off the backyard to a developer who is planning on putting up townhomes. When my neighbor and I complained at the zoning board meeting we were told we should have thought this might happen when we moved in. I've live in my house for 40+ years and my neighbor for 20+, why on earth would we think thnk someone woud sell off their backyard.

You've been in your house for 40+ years and the neighbor 20+ years? A lot can change. Maybe at that time he didn't know his intentions of subdividing his lot. He may have had very different plans, but over time, maybe he decided to downsize and didn't want to deal with such a large lot.
We have a pretty large backyard ourselves and I was planning on having a large yard as well. But, due to family conditions, we added to our house, which took away a large part of the back. Fortunately, I can still enjoy the back. Certainly not as large, but at least we still have a pool and some space to wander about.
If you do get new neighbors, I would casually let them know about your lifestyle to see if there are any objections. If not, no problem. But you'll never know unless you let them know, just to "check the waters".

You misunderstood, the backyard which was sub-divided is next to my neighbors. The then owner sold off the land, then sold the house as well. The new owners will only have a backyard of about 8-10 feet, (an estimated guess based on the plans we sw). The exiting zone law is a minimum of 25 feet for a backyard, so the zoning/planning board has made this a nonconforming property.

Not necessarily. Most zoning variances require a public hearing, sometimes two or more. Get the neighbors together and attend the hearing.
